Key Features of EB-5:

 

Applicants must invest a minimum amount of capital into a new commercial enterprise or a troubled business in the United States. The required investment amount varies depending on the location of the business, either $1.8 million or $900,000 if the investment is made in a targeted employment area (TEA).

 

The EB-5 investment must create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years of the investor’s admission to the United States as a conditional permanent resident.

 

Successful applicants initially receive conditional permanent residency for two years. To obtain unconditional permanent residency, they must demonstrate that the investment has been sustained and the job creation requirements have been met.

 

EB-5 investors can choose between direct investment in their business venture or investment through a USCIS-approved regional center, which pools investors’ funds into larger projects.

 

EB-5 investors and their immediate family members (spouses and unmarried children under 21) can eventually apply for U.S. citizenship, provided they meet all eligibility requirements.
