H1B Visa

The H-1B visa is a non-immigrant visa category in the United States designed for foreign professionals seeking employment in specialized fields. Administered by the U.S. Citizenship and Immigration Services (USCIS), this visa allows employers to temporarily hire foreign workers in occupations that require theoretical or technical expertise.

 

Eligibility Criteria for H-1B:

 

Applicants must have a valid job offer from a U.S. employer willing to sponsor their H-1B visa.

Specialized Occupation: The offered position must qualify as a specialized occupation requiring specialized knowledge and a bachelor’s degree or higher.

 

Applicants must possess a relevant bachelor’s degree or equivalent work experience.

Employer Sponsorship: The employer must file a petition on behalf of the applicant, demonstrating the need for their skills and expertise.

 

The employer must file an LCA with the Department of Labor (DOL), attesting to compliance with wage and working condition requirements.

 

The employer files Form I-129, Petition for Nonimmigrant Worker, with USCIS and supporting documents.

 

Upon approval of the petition, USCIS issues a Form I-797 Notice of Approval, allowing the applicant to apply for the H-1B visa at a U.S. consulate or embassy abroad.

 

Applicants must apply for the H-1B visa at a U.S. consulate or embassy in their home country, provide the required documentation, and attend an interview.

 

The initial H-1B visa is granted for up to three years, with the possibility of extension for an additional three years, totaling a maximum of six years. Extensions beyond six years, such as pending green card applications, may be possible under certain circumstances.

 

H-1B visa holders are tied to the sponsoring employer, and any employment change requires filing a new H-1B petition.

 

While primarily a non-immigrant visa, H-1B visa holders can pursue lawful permanent residence (green card) without jeopardizing their H-1B status.
